LABOUR DEPARTMENT

Departmental Activities     :

The Labour Department has been entrusted with the responsibility of enforcing various Labour Legislations for the welfare of the workman and at the same time also to maintain Industrial peace and Harmony and congenial working atmosphere for economic development and prosperity of the country. The Labour Department has charged mainly with the duties of prevention and settlement of Industrial Disputes. It is also the duty to intervene in the situation of threatened Strikes and Lockouts with a view to avert them. Further, the Labour Department is holding the Quasi judicial function under various Labour Legislation. Further the Labour Department has to enforce the Social Security Act including Andhra Pradesh Building Other and Construction Workers Act, 1996 and Un Organised Workers Social Security Act, 2008 and Implementation of various welfare scheme meant for the wellbeing of the most dis-advantaged sections of the society. It is the duty of the Labour Department to ensure it’s powers in a Lawful manner and as a whole has to do multifarious key functions in the Department.

Brief notes on State Govt. schemes implemented:

(a)A.P. BUILDING & OTHER CONSTRUCTION WORKERS ACT, 1996

The Government of Andhra Pradesh constituted the Andhra Pradesh Building and Other Construction Workers Welfare Board under 33-c(1) of the chapter V-B of the Andhra Pradesh Building and Other Construction Workers( RE& CS) Rules, 1999 Read with section 18(1) of the Andhra Pradesh Building and Other Construction Workers (RE & CS) Act,1996. Accordingly Andhra Pradesh Labour Welfare Board was constituted vide Go.Ms. No:41 of Labour Employment and Trainings and Factories Department, Dated:30-04-2007.

Every eligible construction workers to get himself/herself registered as beneficiaries to avail the benefits of various welfare schemes are implementing for the purpose of well being of construction workers. The main source of income of the Board is by levy of 1% Cess on the total construction cost from the employers that includes State and Central Government, Local bodies, Public sector, Private sector and Individual Employers.

(b) Andhra Pradesh Labour Welfare Fund Act, 1987. 

With the rapid growth of Industries in the state welfare of the Labour has assumed great importance. It has been felt that welfare measures of the Labour are best administered by a non – official agency as is being done in the states of Maharashtra and Gujarat. Where statutory Welfare Board have been constituted and entrusted with the duty of looking after the Welfare of the Labour. On the recommendation of the Andhra Pradesh State Labour Advisory Board, the Government have decided to undertake legislation for the establishment of a Labour Welfare Fund in the state and for the constitution of a Labour Welfare Board for this state for the purpose of administering the fund and to carry on such other functions are as assigned to the board, from time to time. The Act received the Asset of the President on 14th August, 1987. An Act to provide for the constitution of a Welfare fund for the financing of activities to promote Welfare of Labour in the State of Andhra Pradesh and for the establishment of Board and for conducting such activities for Implementation of various Welfare Schemes for the well being of the Labour across the state.

(C) E-SHRAM:

The Labour Department is playing a vital role in registering the un-organised workers in the District on ‘E-SHRAM’ web portal launched on 26th August, 2021 by the Ministry of Labour and Employment for creating a national data base of un-organised workers (NDUW) for all categories of un-organised workers such as Construction workers, Migrant workers, Domestic workers, Agricultural labourers, self-employed workers, Street vendors, Small shopkeepers, Asha workers, Anganwadi workers, fisherman, and similar other sub-group of un-organised workers. .

Objective of the Scheme:

The main objective is to create a centralised database of every un-organised worker, which will help to implement the social security services to them and share their information with various stakeholders for delivering the welfare schemes.

The next objective is the portability of the social security and welfare benefits to the migrant and construction workers and providing a comprehensive database to central and State Governments for tackling any national crisis in future.

Benefits under the E_SHRAM Scheme are as follows:

  1. All informal workers will be allotted an E-Shram Card containing a 12-digit UAN (Universal Account Number) for availing the benefits of various social security schemes announced by both the Central & State Governments. The 12-digit UAN will be valid throughout the country.
  2. All registered workers will be provided accidental insurance coverage though Pradhan Mantri Suraksha Bima Yojana (PMSBY) for a year. The sanctioned amount is Rs. 2 Lakh for accidental death and permanent disability and Rs. 1 Lakh in case of partial disability.

PM SYM :

Objective of the Scheme:

Government of India has introduced a pension scheme for un organised workers namely Pradhan Mantri Shram Yogi Maandhan (PM-SYM) to ensure old age protection for Un organised Workers.

Eligibility:

The unorganised workers mostly engaged as home based workers, street vendors, mid-day meal workers, head loaders, brick kiln workers, cobblers, rag pickers, domestic workers, washer men, rickshaw pullers, landless labourers, own account workers, agricultural workers, construction workers, beedi workers, handloom workers, leather workers, audio- visual workers and similar other occupations whose monthly income is Rs 15,000/ per month or less and belong to the entry age group of 18-40 years. They should not be covered under New Pension Scheme (NPS), Employees‟ State Insurance Corporation (ESIC) scheme or Employees‟ Provident Fund Organisation (EPFO). Further, he/she should not be an income tax payer.

         As the East Godavari District has got the distinction of 2,78,108 construction workers registered as beneficiaries so far under Andhra Pradesh Building and Other Construction Workers Act. The Labour Department has extended support to the most dis-advantaged section of the society by implementing various Welfare schemes through the Andhra Pradesh Building and Other Construction Workers Welfare Board for the well being of construction workers in the District. As we have achieved remarkable progress by extending various Welfare Schemes to the extent of rupees so far 39,04,54,300/- to the 17,667 beneficiaries.
